Micah Washington, a 24-year-old Black man who drew national notice after being violently tased by a Reform, Alabama police officer, has made legal progress. Washington’s felony fentanyl trafficking allegation was withdrawn after it was discovered that the material he was suspected of possessing wasn’t a narcotic.

Washington was confronted by Reform officer Dana Elmore while repairing a flat tire. After Elmore tased Washington, who was arrested and face-down on her police car hood, the traffic stop turned violent.

New information about the altercation have illuminated its causes. Washington’s attorney, Leroy Maxwell Jr., said the 24-year-old was repairing a flat tire outside his aunt’s house. His friends kept returning to get tire change equipment. Unfortunately, ongoing racial profiling may have contributed to Washington’s meeting with Officer Elmore.

The first tasing occurred after Washington, who claimed innocence, refused to provide Elmore his ID. This casts doubt on Washington’s charges of impeding government operations, resisting arrest, and first-degree marijuana possession.

Elmore’s disproportionate force was shown on film, sparking controversy. Handcuffed, Washington lies face-down on a vehicle’s front as Elmore holds a stun pistol to his back. Washington cries out while tased while restrained.

After Washington was handcuffed, Officer Elmore used the stun gun twice, raising concerns. Elmore’s hostility may have escalated after Washington recorded the encounter on his phone, demonstrating police brutality.

An already tough scenario is complicated by the dismissed narcotics allegation. Washington faced harsh penalties for fentanyl trafficking. However, further testing showed that the fentanyl-positive material was not a drug. After learning this, 24th Judicial Circuit District Attorney Andy Hamlin moved to dismiss the charge, which District Judge Lance Bailey granted.

Attorney Leroy Maxwell Jr. plans to bring a $20 million lawsuit on behalf of Micah Washington to clear his name. Maxwell stresses excessive force instances and promises to hold all culpable parties accountable.

“Every day, excessive force occurs,” Maxwell said. Thank goodness that was filmed. We will keep working until Micah’s name is clear and all culpable parties are held accountable. Abuse of force and bogus criminal allegations against Micah are apparent.”

Reform authorities have taken steps to thoroughly investigate the arrest while Officer Dana Elmore is on paid administrative leave. To provide all incident materials, the agency is working with the Alabama State Bureau of Investigation.

Legal experts worry about police using charges to justify aggression. The case also questions police brutality officers’ responsibility, especially when video evidence contradicts official statements.
