A lawsuit has been filed against the Trump administration by seven transgender individuals challenging the recent removal of the “X” gender marker from U.S. passports. The American Civil Liberties Union (ACLU) represents the plaintiffs, arguing that the policy violates privacy and First Amendment rights.

“In 2022, the State Department introduced the option for passport applicants to select “X” as their gender marker instead of just “M” or “F.””

The executive order, titled “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government,” defines sex strictly as male or female. It prohibits gender identity from being used in legal and administrative contexts, affecting policies in housing, education, and public services.

The ACLU contends that this policy puts transgender individuals in danger. Many rely on accurate documentation for travel, employment, and daily life. Affected individuals fear being “outed” when their documents do not match their gender identity, leading to discrimination or safety risks.

Reid Solomon-Lane, one of the plaintiffs, expressed concern about the policy’s impact on his life.

“Everyone in my personal and professional life knows me as a man, and any stranger on the street who encountered me would view me as a man,” Solomon-Lane said. “Now, as a married father of three, Trump’s executive order and the ensuing passport policy have threatened that life of safety and ease.”

The lawsuit has drawn national attention as more than 1,500 transgender individuals and their families have contacted the ACLU with concerns about passport applications being delayed or denied. Critics of the executive order argue that it erases legal recognition for nonbinary individuals and undermines progress toward LGBTQ+ rights.

The Trump administration has defended the policy, stating that it aims to maintain legal consistency and prevent “gender ideology” from influencing federal documents. Supporters believe that official records should reflect biological sex, not gender identity.

As legal battles unfold, transgender Americans face uncertainty about their ability to travel and access services. The outcome of this case could have significant implications for gender identity recognition in the U.S.
