Attorneys for Sean “Diddy” Combs are taking legal action to dismiss a federal charge against the music mogul, arguing that the prosecution is rooted in racial bias. Combs, who remains in federal custody, is facing multiple charges, but his defense is specifically challenging Count Three of the indictment which pertains to the transportation of individuals for the purpose of prostitution.
In a motion filed on Tuesday evening, Combs’ legal team contended that the charge is unprecedented particularly in its application against a high-profile Black figure.
“This case is unique in many ways, but most disturbingly, no White individual has ever faced prosecution under remotely similar circumstances,” the filing states.

“Mr. Combs has been singled out due to his power and influence, and he is being prosecuted for conduct that has historically gone unpunished when committed by others,” the motion argues.
Combs’ attorneys are seeking the dismissal of the charge under the Mann Act, a law enacted in 1910 under the original name, the White Slave Traffic Act. Initially designed to combat human trafficking and forced prostitution, the statute has a controversial history, often criticized for its discriminatory enforcement.
While the Mann Act has been applied in high-profile cases, such as the 2021 conviction of Ghislaine Maxwell Jeffrey Epstein’s longtime associate Combs’ legal team argues that it has predominantly been used against men of color. “What was racist in its inception has often remained racist in its execution,” the attorneys wrote, emphasizing that the law was historically wielded to target Black men under the guise of protecting White women.
Combs is currently facing three federal charges, including racketeering conspiracy and sex trafficking, alongside the Mann Act charge. He has pleaded not guilty to all accusations and remains detained at a federal facility in New York City.
As of Tuesday evening, Combs’ attorneys have refrained from providing additional comments regarding the motion to dismiss the charge.
