Kodak Black is requesting that a court dismiss his outstanding drug charges in Florida after lab testing revealed that the white material obtained during his recent arrest was the prescription opioid oxycodone, not cocaine.
In a sworn petition filed Monday in Broward County, defense attorney Brad Cohen claims the multiplatinum-selling rapper had a legitimate prescription at the time of his arrest on December 7, 2023, so his charges should be dismissed.
Black, whose official name is Bill Kapri, has been in custody for many weeks. Cohen intends to fight for his release during a bail hearing on Friday, but even if the state court agrees, Kapri will not leave.
Cohen would then go to federal court, where the state case sparked hearings on the probable revocation of Black’s national supervised release, which stemmed from his 2019 conviction for making a false statement during a gun transaction.
Cohen tells the media that the state lawsuit is an “abuse of power” with unjust repercussions. The arrest record states that Kapri plainly and freely informed his arresting officer, Plantation Police Officer Adam Stern, that the white substance was Percocet.
Despite this promise, Stern said in his report that the material “field-tested positive on the scene for cocaine.” Stern reportedly said Kapri attempted to conceal the powder after being discovered sleeping at the wheel of his black Bentley near Fort Lauderdale.
Stern also went to federal court on December 19 and testified against Kapri, which prompted a judge to order the rapper’s detention until a more extensive hearing on the termination of his federal supervised release.
When the lab tests turned up negative for cocaine, the Broward County State Attorney prosecuted Kapri with unlawful oxycodone possession instead. Cohen says that this was also an abuse. “I chatted with them before they filed their complaint.
I warned them it would come back as oxycodone. Cocaine does not cause people to fall asleep. I informed them that I would give them a genuine prescription for oxycodone. They never answered my call. “It demonstrates a real bias, which is not what our justice system is about,” Cohen adds.
“Prosecutors will review any documentation or prescriptions the defense wishes to provide at any time,” Broward County State Attorney spokesman Paula McMahon told Rolling Stone Monday.
“Speaking generally and not specifically about this case, a detailed legal process is required to verify the validity of prescriptions,” Two weeks ago, McMahon said prosecutors brought charges only when the lab test results were obtained.
“Police arrested him on suspicion of cocaine possession. “Our office did not file that charge,” McMahon said in the previous email.
Shortly after Kapri was apprehended and jailed on December 7, Cohen filed a move to suppress what he called an “unlawful investigatory stop and arrest.”
He said Kapri was not impeding traffic when apprehended on a residential street near the Fort Lauderdale Country Club in Plantation. Cohen said the first officer neglected to “blow his horn or otherwise request” that Kapri relocate his car before beginning the incident.
Cohen also slammed the officer’s handling of the arrest and his testimony in federal court. “The cop said crack cocaine, but it turned out to be oxycodone.”
I’m not sure how an issue like that occurs. In my 27-year tenure, I have never seen an officer test an oxycodone tablet and find it positive for cocaine. This officer was either severely negligent, inept, or dishonest. It’s one of those three,” Cohen previously said to the media.
“I’m going to ask for an internal investigation of this officer and his testimony, which is incredulous.” The lawyer also said there was no body-worn camera footage from the arrest, which he described as “disgusting.”
Kapri, 26, was halfway through a three-year federal prison term for fabricating documents to purchase firearms at a Miami gun shop until then-President Donald Trump reduced it on his last day in office in January 2021.

In a second Broward County case, Kapri is defending claims that he was trafficking oxycodone when he was stopped in July 2022 with white pills and over $75,000 cash in his car. Prosecutors say he trafficked between 14 and 25 grams of oxycodone.
A defense move to dismiss that case claims officials mismanaged evidence and that several of the pills tested positive for acetaminophen. Kapri was free on bail when he was ordered to join a drug rehabilitation program for 30 days last year after testing positive for fentanyl on February 8, 2023.
