AG Letitia James Recuses Office from Investigation into Upstate Inmate’s Death by Prison Guards

New York Attorney General Letitia James has stepped away from overseeing the investigation into the death of Robert Brooks, an inmate allegedly beaten to death by correctional officers at the Marcy Correctional Facility. The decision follows the revelation of a conflict of interest, as James’ office is simultaneously involved in unrelated legal cases defending four of the guards implicated in Brooks’ death.

In a video statement, James announced the appointment of Onondaga County District Attorney William J. Fitzpatrick as the special prosecutor for the case.

 “This decision was not made lightly,” she explained, emphasizing that recusal was necessary to maintain the investigation’s credibility and ensure accountability for Brooks’ death.

Simultaneously, Governor Kathy Hochul has taken steps to address broader issues at Marcy Correctional Facility. She has removed interim superintendent Danielle Madbury, appointing Bennie Thorpe, the current superintendent of Shawangunk Correctional Facility, as Marcy’s new leader. Thorpe brings over 20 years of experience in New York’s prison system and, despite having no previous affiliation with Marcy, is expected to introduce “expertise and a fresh perspective” to the institution’s leadership, Hochul said.

The urgency surrounding the case has been amplified by graphic body camera footage released by James’ office. The video depicts three correction officers viciously assaulting Brooks, 43, while he was handcuffed and posed no apparent threat. Other officers are seen standing idly by as the attack continued, even after Brooks lost consciousness.

Governor Hochul has called for swift action, urging Fitzpatrick to expedite charges against those responsible. “The video of this horrific attack demonstrates clear crimes were committed,” she asserted, adding that initial charges should be filed immediately, even as more serious allegations are considered through further investigation.

Brooks’ death, which occurred on December 9, has sparked widespread outrage, intensifying demands for justice and systemic reform. With new leadership at Marcy and a special prosecutor spearheading the investigation, state officials aim to ensure justice for Brooks while addressing systemic issues to prevent future tragedies. This case serves as a stark reminder of the urgent need for transparency, accountability, and reform in New York’s correctional facilities.
