President Donald Trump announced Monday that he is voiding all pardons issued by former President Joe Biden that were authorized using an autopen. Trump claimed the pardons were invalid because Biden did not personally sign them or understand the documents.
“The ‘Pardons’ that Sleepy Joe Biden gave to the Unselect Committee of Political Thugs, and many others, are hereby declared VOID, VACANT, AND OF NO FURTHER FORCE OR EFFECT, because of the fact that they were done by Autopen,” Trump posted on Truth Social.
Trump further argued that Biden was unaware of the pardons and suggested that those who facilitated them might have committed a crime. “The necessary Pardoning Documents were not explained to, or approved by, Biden,” Trump added. “He knew nothing about them, and the people that did may have committed a crime.”
Biden issued several last-minute pardons, including preemptive ones for General Mark Milley and Dr. Anthony Fauci. Milley had criticized Trump, calling him a “wannabe dictator,” while Fauci faced accusations of misleading Congress regarding the origins of COVID-19.
Trump’s declaration also targeted members of the January 6 House Select Committee, who received preemptive pardons. Trump warned that they would be “subject to investigation at the highest level.”
Missouri Attorney General Andrew Bailey has echoed Trump’s concerns, demanding an investigation into whether Biden’s cognitive decline allowed unelected staff to authorize executive actions without his approval.
Legal experts are now questioning whether Trump’s statement holds any legal authority. However, the controversy has added fuel to the political battle between Trump and Biden, further intensifying the 2024 election landscape.
